Terms of Service

Larkko is operated by Tech Loft GH Ltd (“Larkko,” “we,” “us,” or “our”), a company registered in Accra, Ghana. These Terms of Service (“Terms”) govern your access to and use of the Larkko platform (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.

“Account” means the account you create to access the Service. “Content” means any contact lists, messages, or other data you upload to or generate through the Service. “You” means the individual or business using the Service under an Account.

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for business use, primarily sending SMS and email communications to your own customers or contacts. You agree to provide accurate information when creating an Account.

You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account. Notify us immediately at [email protected] if you suspect unauthorized use of your Account.

You agree not to use the Service to:

• Send unsolicited messages to contacts who have not consented to receive them
• Send content that is illegal, fraudulent, or misleading
• Impersonate another person or business, or spoof a sender identity
• Violate any applicable telecommunications, data protection, or spam law

You are solely responsible for obtaining and maintaining consent from every contact you message through the Service.

The Service is offered on Free, Starter, Growth, and Business plans, described on our pricing page. Paid plans are billed monthly and renew automatically until cancelled. Usage beyond your plan's included allowance is billed at the overage rate shown on the pricing page. You may cancel at any time; cancellation takes effect at the end of your current billing cycle.

Larkko uses artificial intelligence to help draft message content on your behalf. You are responsible for reviewing and approving all AI-drafted content before it is sent. Larkko does not guarantee the accuracy, tone, or suitability of AI-generated drafts for your specific use case.

SMS messages are delivered through third-party mobile network operators and SMS gateway providers. Email messages are delivered through Amazon Simple Email Service (SES). Delivery, timing, and formatting of messages are subject to the policies and technical limitations of these third parties, and Larkko does not guarantee delivery of any message.

Larkko and its licensors retain all rights to the Service, including its software, design, and branding. You retain ownership of your Content, including your contact lists and messages.

You may stop using the Service and close your Account at any time. We may suspend or terminate your Account if you violate these Terms, including the Acceptable Use provisions above.

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Larkko's total liability arising from your use of the Service is limited to the amount you paid us in the 12 months before the claim arose.

You agree to indemnify and hold Larkko harmless from any claims arising from your Content, your use of the Service, or your violation of these Terms.

These Terms are governed by the laws of Ghana.

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect.
